These Terms govern your use of PostUp, a product of Mobilogical LLC (“PostUp,” “we,” “us,” or “our”). By creating an account or using PostUp, you agree to these Terms and our Privacy Policy. If you use PostUp for a dealership or other organization, you represent that you have authority to accept these Terms for that organization.
The service
PostUp imports dealership inventory, assists with listing copy, opens third-party social services in an embedded browser, helps fill listing fields, organizes publishing work, and records user-entered results. You remain responsible for reviewing each listing, confirming that its vehicle, price, claims, photos, and availability are accurate, and choosing whether to publish it.
Accounts and acceptable use
You must provide accurate account information, protect access to your device and verification codes, and promptly report suspected unauthorized use. You may use PostUp only for inventory you are authorized to market and only in compliance with applicable laws, dealership policies, advertising rules, and the terms of each third-party platform.
You may not use PostUp to misrepresent a vehicle, price, identity, affiliation, financing term, or availability; scrape or access accounts without permission; defeat platform security or rate limits; distribute malware; interfere with PostUp; reverse engineer protected service components except where law permits; or use the service for illegal, deceptive, discriminatory, or abusive activity.
Facebook and other third-party services
PostUp is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., Facebook, Instagram, TikTok, MarketCheck, Apple, or Google. Third-party services can change, suspend, reject, or remove functionality at any time. PostUp does not guarantee that a platform will accept a listing or that use of a third-party account will be uninterrupted. You control your Facebook session and publish each Marketplace listing yourself.
Subscriptions, trials, and renewal
Self-serve subscriptions are purchased through Apple and managed with RevenueCat. The exact localized price, billing period, included trial, and renewal terms shown in the app’s purchase sheet control your transaction. Unless cancelled at least 24 hours before the end of the current period, an Apple subscription renews automatically and Apple charges your account. Manage or cancel through your Apple subscription settings. Trial eligibility is determined by Apple and may not be available to every account.
Floor access may have a minimum seat quantity. Organization owners control invitations and roles and are responsible for charges associated with their plan. Custom Rooftop services may be governed by an additional written order form. Except where law or Apple policy requires otherwise, fees are non-refundable; refund requests for App Store purchases are handled by Apple.
Your content and feedback
You retain ownership of content you submit. You grant PostUp a limited license to host, process, format, and transmit that content solely to operate and improve the service. You represent that you have the rights needed for vehicle photos, dealership information, captions, and other content. If you provide feedback, you allow us to use it without restriction or compensation, provided we do not identify you publicly without permission.
AI-assisted copy
AI-generated text can be incomplete or incorrect. PostUp is designed to ground copy in supplied vehicle data, but you must review all generated language before use. Do not rely on generated copy for legal disclosures, warranties, financing terms, or claims not independently verified by your dealership.
Availability, changes, and termination
We may change the service, address security issues, or discontinue features. We may suspend or terminate access for material or repeated violations, abuse, nonpayment, risk to users or third parties, or legal requirements. You may stop using PostUp and delete your account from the app. Terms that by their nature should survive termination—including payment obligations, ownership, disclaimers, limits, and dispute terms—will survive.
Disclaimers and limitation of liability
To the maximum extent permitted by law, PostUp is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee vehicle sales, leads, gross, platform availability, feed accuracy, or account outcomes.
To the maximum extent permitted by law, Mobilogical LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profit, lost data, lost goodwill, or business interruption. Our aggregate liability arising from PostUp will not exceed the amount you paid for PostUp during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
Indemnity and governing law
You agree to defend and indemnify Mobilogical LLC from third-party claims arising from your content, listings, misuse of PostUp, violation of law or platform terms, or infringement of another party’s rights. These Terms are governed by the laws of the State of New York, without regard to conflicts rules, and disputes will be brought in the state or federal courts located in New York, unless applicable consumer law requires otherwise.
Changes and contact
